The Home Office is participating in ongoing negotiations on 25 EU legislative files. Of those, the UK will only be bound by 9 files as a result of the UK’s ability to not opt in or opt out under the UK’s JHA and Schengen Protocols respectively. Until the UK leaves the EU, and during the proposed Implementation Period, the UK is required to give effect to these measures, once agreed by the EU.
