To ask the Secretary of State for Justice what proportion of claimants have appealed successfully against the original Atos determination of their capacity to work in each year since 2009.

The First-tier TribunalSocial Security and Child Support (SSCS), administered by HM Courts and Tribunals Service (HMCTS) hears appeals against Department for Work and Pensions (DWP) decisions on entitlement to employment and support allowance (ESA), decisions in which the work capability assessment (WCA) undertaken by Atos is a key factor, rather than appeals against WCA decisions themselves or Atos themselves. HMCTS does not, therefore, hold the information requested.
