Not all the proposals in the social action programme are being brought forward under article 100A, but my hon. Friend is right to say that some are, and they are being introduced on the most tenuous basis. I make it quite clear in the Social Affairs Council of Ministers that that is the case. If necessary, at the end of the day we shall not hesitate to take these matters to the European Court of Justice.
