I beg to move amendment No. 13, in page 6, line 37, after 'tort', insert `or in reparation'.

The amendment adapts clause 9(2) for Scotland. The clause refers to the Crown's liability in tort under the Crown Proceedings Act 1947. However, the word "tort" is an English legal term of art. The 1947 Act defines it for Scotland as any wrongful or negligent act or omission giving rise to liability in reparation". The amendment reflects the terms of this definition by adding a reference to the Crown's liability in reparation under the 1947 Act.
