If the court—that is, the judge—believes that the confession has been improperly obtained, it is entirely up to him to reject it. It is wrong for the hon. Gentleman to say that in deciding whether a confession has been properly obtained the burden of proof shall rest upon the police. Their purpose is not to determine the law. They are there to provide the prosecution and the evidence. It is for the court to determine whether the evidence has been properly obtained.
