asked the Secretary of State for Scotland whether he proposes to take any action to have the provisions of the Money Payments (Justices Procedure) Bill extended to apply to Scotland?

Owing to differences in the law and practice of the two countries, it would not have been practicable to apply to Scotland the provisions of the Bill referred to by the hon. Member. I am considering whether similar legislation should be introduced for Scotland.

I know that part of the provisions are in effective operation in Scotland, but could not the right hon. Gentleman, under the part of the Bill dealing with prisoners, issue a circular to procurators-fiscal and others that in the meantime they should, as far as possible, carry out the spirit of the Bill introduced for England?

Until the law is altered I cannot make that recommendation, but I am making inquiries on the subject forthwith.
